1. Introduction
By enrolling in the POWERVISION service, you become a Subscriber and agree to be bound by this Agreement (the "Agreement"). This
Agreement is subject to change by POWERVISION at any time, and changes are effective upon notice to each Subscriber. POWERVISION
is an interactive information and transaction service, designed primarily to provide information regarding the purchase of goods and services
at discount prices to Subscribers via personal computer or by audiotex response over ordinary telephone lines.
2. Subscriber Responsibilities
Subscribers are responsible for payment of all monthly subscriber's service fees and excess access fees (if applicable), special or premium
services incurred, and for payment of all charges, including merchandise or services purchased through the service.
Subscribers will be given access to billing records that support charges for use of the POWERVISION service. Each Subscriber is responsible
for payment for merchandise or services purchased through the service. Subscribership may not be assigned or transferred to any other
person or entity.
Subscribers must promptly inform POWERVISION of the following: changes in the expiration date of any credit card they use in connection
with the POWERVISION service; changes in their home or billing address and, apparent breaches of security, such as loss, theft, or
unauthorized disclosure or use of an ID or password. Until POWERVISION is notified, by electronic or conventional mail, or by telephone
at 1-619-546-2343 of a breach of security, the Subscriber will remain liable for any unauthorized use of the POWERVISION service.
3. Fees and Payment
Some or all of the following fees may be incurred by POWERVISION service Subscribers:
a. POWERVISION fees. 1) Service Fees. The Subscriber is responsible for paying periodic service fees according to the then-current billing
terms. POWERVISION reserves the right to change fees or institute new fees at any time, effective upon 30 days notice to the Subscriber.
2) Premium services. The Subscriber is responsible for paying for premium services offered through POWERVISION and provided to
authorized Subscribers. The costs associated with accessing premium services will be identified on the first screen when entering the premium
service and no charge will be incurred until a Subscriber proceeds beyond this initial informational screen.
b. Merchandise, services and information. Subscribers may order, and are responsible for paying for, a variety of merchandise or services
from Merchants through the POWERVISION service. Merchants are independently owned and operated businesses. The purchase,
payment, warranty, guarantee, delivery, maintenance and all other matters concerning merchandise, services, or information ordered from
Merchants are solely between the Subscribers and the Merchant. POWERVISION shall in no event be deemed a party to such transactions
or be liable for any actions or inactions of such Subscribers or Merchants. Warranties of Merchants will be available for review upon request,
and will be part of any agreements or orders that Subscribers enter into via the POWERVISION service.
c. Telephone charges. Subscribers are responsible for payment of charges for the connection between the Subscriber's personal computer
and the local POWERVISION service telephone exchange.
d. Payment. Payment for the appropriate services may be made by automatic credit card debit or by automatic bank draft. You will receive
an electronic invoice 3 days prior to the debit itemizing the charges to be debited. The basic monthly service fee is payable in advance.
4. Termination of the POWERVISION service
Delivery of the POWERVISION service may be terminated at any time, and without cause, by either POWERVISION or Subscriber upon
notification to the other. Subscribers are liable for any charges incurred by them until termination of service. Upon termination of service
to any Subscriber, the license to use the POWERVISION software, as described in Section 6, is also terminated as to that Subscriber.
5. Access to the POWERVISION service
Subscribers are responsible for providing all personal computer and communications equipment necessary to gain access to the POWER-
VISION service. In most cases, POWERVISION will provide a local telephone number for accessing the service. Subscribers wishing to
access the POWERVISION service from locations outside their local telephone exchange should contact POWERVISION Customer
Support. Hours of access to the POWERVISION service are as stated on the service, subject to interruptions at POWERVISION's
discretion. Unauthorized access to the POWERVISION service or to restricted portions of the service is a breach of this Agreement and a
violation of law.
IDs and Passwords. Access to and use of the POWERVISION service is through a combination of an ID and a password. Your social
security number will be your identification number.
POWERVISION will supply new Subscribers with a temporary password, which they will be required to change upon enrollment. Each
Subscriber must keep their password strictly confidential. For security reasons, Subscribers are advised to change their password frequently.
Remember your password! POWERVISION may reissue a password if forgotten by a Subscriber, but reserves the right to charge for reissued
passwords.
